ARTICLE 1. GENERAL CONDITIONS OF SALE

 By visiting ALEXANDRA MARGNAT website www.alexandramargnat.com, you are accepting and consenting to be bound by the Terms & Conditions provided herien, as well as the Privacy Policy.

We reserve the right, in our discretion, to update or modify the Terms & Conditions at any time by posting such new terms on the site. The following Terms & Conditions are concluded in between, on one side, the company APE CREATION SAS located in 4 Avenue d’Eylau, 75116 Paris, FRANCE (contact number 06 20 28 16 06) and on the other hand, by all natural or legal person wishing to make a purchase via the website «ALEXANDRA MARGNAT» hereinafter referred to as the «Buyer».

ARTICLE 2. OBJECT

The Terms & Conditions of sale aim to define the contractual relations between ALEXANDRA MARGNAT and the Buyer. These conditions are applicable to any purchase made through the commercial site ALEXANDRA MARGNAT, whether the Buyer is professional or consumer. The acquisition of a property through this site implies an unreserved acceptance of these Terms & Conditions by the Buyer. These Terms & Conditions will prevail over any other general or particular conditions that are not approved by ALEXANDRA MARGNAT. ALEXANDRA MARGNAT reserves its right to modify its Terms & Conditons at any time beyond ALEXANDRA MARGNAT’s reasonable control. In this case, the conditions applicable will be those in effect on the date of the order by the buyer.

PRODUCTS

The products for sale are the ones listed on the Site www.alexandramargnat.com within the stock available. Every product is accompanied with a description established on the basis of the information provided by the supplier. The products sold on the Site are in conformity with the applicable legal regulations in France. The Buyer is the only one responisble for the choice of products, their maintenance and their use. The photos shown on the catalog ressemble the most on the products but can not ensure a perfect similarity to the product offered, especially regarding to colors and materials.

ARTICLE 3. PRICES

The price listed on the catalog are shown in euros (€) including taxes (VAT), but excludes delivery costs which are also detailed. ALEXANDRA MARGNAT reserves its right to change its prices at any time beyond ALEXANDRA MARGNAT’s reasonable control, but the products will be invoiced on the basis of the current prices at the moment of the order placement. Additional charges such us  delivery costs will be indicated and specified during the order validation process.

AREA

The products shown on the Site are available to international buyers. However, for orders located outside France may possibly be subject to customs duties and dock dues.

ARTICLE 4. ORDERS

When placing an order, you must have full legal capacity to sign up to these Terms & Conditions. All orders by Buyer are subject to acceptance by ALEXANDRA MARGNAT. Any confirmation and payment of your order entails acceptance of the Terms & Conditions, acknowledging that you have received all of the necessary information before the validation of purchase. All data provided by the Buyer and the registered confirmation will be proof of the transaction.

A confirmation e-mail will be sent to you acknowledging the summary of your purchase including its estimated delivery time, once your order is validated.

RIGHT OF WITHDRAWAL

In accordance with the provisions of Articles L221-18, according to the Consumer code, the customer has a period of fourteen (14)  days to withdraw its purchase without having to justify any reason.

The fourteen (14) day period shall run

  • From the day the customer or a third party, who is not the carrier, designated by the customer that recieved the ordered item.
  • Or, in case of an order with several items that are delivered separately, from the day the customer or a third party, who is not the carrier, designated by the customer that recieved the last item.
  • The customer must notify the company by completing the online form available on the Site in «My Returns» section on the customer account. In case of a non-creation of account, it is also possible to issue a request for withdrawal, either by sending the withdrawal form (available below and accessible via hyperlink in the order confirmation e-mail), or sending an unambiguous statement at :

ARTICLE 5. PAYMENT METHODS

  • The Customer will follow the terms indicated in the order form for the product and shipping payment.
  • The Customer has the possibility to pay his orders via credit card (CB, MasterCard®, Visa®, American Express®), PayPal or bank transfer.
  • In case of bank transfer payment, the Customer has ten (10) working days from the order confirmation to transfer the agreed sum. A reminder will be sent to the Customer within eight (8) days if the discounted amount has not yet been received on the Company’s bank account.
  • In cas of payment by PayPal, the Customer expressly acknowledges and accepts PayPal’s Terms & Conditions, solely responsible for the processing of personal data relating to the means of payment entered by the Customer.
  • During the payment, the bank requests personal information from the user to verify the identity of the cardholder and to validate the transaction. The Customer will have to transmit his credit card number, according to the type of card, the expiration date and the cryptogram number (3-digit number on the back of the credit card).
  • The Customer guarantees to the Company, when validating its order form, that he is in a regular situation with repsect to the issuer of the payment card.
  • The financial information will be transferred by means of a cryptographic protocol to PayPal or to other banks providing the services related to remote electronic payment, without the possibility of third parties accessing it.

ARTICLE 6. DELIVERY

The delivery time for your order is subject to availability of the stock, items purchased are delivered within few days if stocks are available. Orders are shipped to the address indicated in the order form. Risks are borne by the purchaser from the moment the products have left the premises of APE CREATION. In case of damage during the shipping, the reasoned protest must be filed by the carrier within three (3) days from the delivery. Delivery times are given for information purposes only; if these exceed thirty (30) days from the order, the sales agreement can be canceled and the buyer is refunded.

INTELLECTUAL PROPERTY

The Site is the property of the Company, hereby named APE CREATION, herein called ALEXANDRA MARGNAT. It is protected by international copyright laws and treaties, as well as by other international intellectual property laws and treaties. All rights to the Site and the overall concept of the the Company, to their original and innovative character, in particular intellectual property rights to texts, literary, artistic, graphic (including photographs) and audiovisual creations, computer developments, HTML developments and other works of art, Spirit, and more generally all creations that may be protected by intellectual property law such as images, logos, formatting, graphic charter, structure, ergonomics, color codes, typography, fonts, basic graphic elements, screen graphic organizations, layout, backgrounds, visual identity of the Site, belong to the Company or are regularly exploited by the Company, without any limitation . The Customer undertakes not to interfere directly or indirectly with the Company, the Site or the rights of the Company.

ARTICLE 7. ARCHIVING PROOF

ALEXANDRA MARGNAT will archive purchase orders and invoices on a reliable and durable medium constituting a trustworthy copy in accordance with the provisions of article 1348 of the Civil Code. The computerized records of ALEXANDRA MARGNAT shall be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Dispute Resolution

These online sale terms are governed by French law. In case of a dispute, jurisdiction is granted to the competent courts of Paris, notwithstanding the presence of multiple defendants or third-party claims.

In the event of damage during transport, a justified complaint must be made to the carrier within three days of delivery. Delivery times are given as an estimate only; if they exceed thirty days from the order date, the sales contract may be terminated and the buyer refunded.

Intellectual Property

The Site is the property of the Company. It is protected by copyright laws and international treaties, as well as by other international intellectual property laws and treaties. All rights relating to the Site and the overall concept of the Company's activities, their original and innovative nature, including intellectual property rights on texts, literary and artistic creations, graphics (including photographs), audiovisual works, software developments, HTML developments, and other intellectual creations, as well as more generally all works that can be protected by intellectual property law—such as images, logos, layout, graphic design, structure, ergonomics, color codes, typography, fonts, basic graphic elements, screen design, page layout, background images, the visual identity of the Site—belong to the Company or are regularly used by it without any limitation. The Client agrees not to directly or indirectly infringe upon the Company, the Site, or the Company's rights.
